Introduction

Gettysburg Trading Post, a Federal Firearms Licensee (FFL) located at 2222 York Rd., Gettysburg, PA 17325, is committed to complying with all federal, Pennsylvania, and local firearms laws, including the Gun Control Act (GCA) and ATF regulations. This Firearms Sales and Compliance Policy outlines our procedures for shipping, returns, refunds, and regulatory compliance for firearms, ammunition, and accessories.

Shipping Policy

Overview

We adhere to strict ATF regulations for shipping firearms and ammunition, as outlined in 27 CFR § 478.31 and related statutes. All shipments comply with federal and state laws.

Firearms Shipping

  • FFL Requirement: All modern firearms are shipped only to a valid FFL holder, per 27 CFR § 478.94. Non-FFL buyers must arrange for a licensed dealer in their state to receive the firearm and provide a signed copy of the receiving FFL’s license before shipment.

  • Interstate Sales: Firearms may be shipped to an FFL in the buyer’s state of residence. The receiving FFL completes the ATF Form 4473 and National Instant Criminal Background Check System (NICS) check (27 CFR § 478.94).

  • Over-the-Counter Exception: Rifles and shotguns may be sold over-the-counter to non-residents if compliant with federal, Pennsylvania, and buyer’s state laws. Frames and receivers not configured as rifles or shotguns cannot be sold to non-residents (27 CFR § 478.99).

  • Antique Firearms: Firearms manufactured in or before 1898, or replicas not using modern ammunition, may be shipped directly to buyers without an FFL, per 27 CFR § 478.11.

  • Handguns: Must be shipped via a common or contract carrier (e.g., UPS, FedEx) by an FFL. Non-FFL individuals cannot ship handguns via USPS (27 CFR § 478.31).

  • Carrier Notification: We inform carriers that packages contain firearms, as required by 18 U.S.C. § 922(e). Packages are not labeled to indicate firearms.

Ammunition Shipping

  • Ammunition is shipped separately from firearms, per ATF and carrier regulations.

  • We do not ship ammunition to New York City, Washington, D.C., Los Angeles, Oakland, Sacramento, San Francisco, Avalon, or Alaska due to local restrictions.

  • Pennsylvania residents may receive ammunition without an FFL, but other states may require an FFL for receipt.

Shipping Carriers

  • We use UPS or FedEx for firearms and ammunition, as they accept FFL shipments. USPS is used for rifles and shotguns by licensed FFLs only.

  • Firearms are shipped unloaded, and ammunition is not included in the same package.

Processing and Delivery

  • Orders ship within 7-10 business days after receipt of payment and a valid FFL, if applicable.

  • Shipping costs are calculated at checkout and vary by carrier and destination.

  • We ship to the address on the receiving FFL’s license or your provided address for non-FFL items.

Restrictions

  • We do not ship to prohibited persons or jurisdictions where firearms or ammunition are illegal.

  • International shipping is not available.

Returns and Refunds Policy

Overview

We offer returns and refunds for eligible items in compliance with federal and state laws. This section outlines the process for firearms, ammunition, and accessories.

Firearms Returns

  • Firearms may be returned within 20 days of receipt if defective upon delivery.

  • Returns are not accepted for buyer’s remorse or firearms that have been used, modified, or transferred via ATF Form 4473.

  • Defective firearms must be returned to 2222 York Rd., Gettysburg, PA 17325, with a copy of the receiving FFL’s license and proof of purchase.

  • Returns require ATF approval if the firearm has been recorded in our Acquisition and Disposition (A&D) records (27 CFR § 478.125).

Ammunition Returns

  • Ammunition sales are final and non-returnable due to safety and regulatory concerns.

Accessories Returns

  • New, unopened accessories may be returned within 20 days for a refund, excluding shipping costs.

  • Installed or opened accessories are not returnable but may be covered by manufacturer warranties. Contact the manufacturer directly.

Refund Process

  • Refunds are issued to the original payment method within 7-10 business days of receiving the returned item.

  • Original shipping charges are non-refundable unless the item is defective.

  • Return shipping costs are your responsibility unless the item is defective.

Firearms Compliance Policy

Licensing

  • We hold a valid Type 01 FFL for dealing in firearms, issued by the ATF, renewed every three years per 27 CFR § 478.47.

  • Our operations comply with Pennsylvania’s state gun dealer’s license requirements.

Recordkeeping

  • We maintain A&D records for all firearms acquisitions and dispositions, per 27 CFR § 478.125, including details like serial numbers, dates, and buyer/seller information.

  • A&D records are retained for 20 years, and Form 4473 records are kept for at least 20 years after the sale or disposition (27 CFR § 478.129).

  • Records are stored securely at our premises and available for ATF inspection.

Sales and Transfers

  • All firearms sales require a completed ATF Form 4473 and NICS background check, per 27 CFR § 478.124.

  • We report multiple handgun sales (two or more in five business days to the same person) to the ATF on Form 3310.4, per 27 CFR § 478.126a.

  • Interstate transfers are shipped only to a licensed FFL in the buyer’s state, with the receiving FFL handling Form 4473 and NICS checks (27 CFR § 478.94).

Prohibited Sales

  • We do not sell to prohibited persons, including felons, domestic violence offenders, or those under 21, per 27 CFR § 478.99.

  • Sales comply with Pennsylvania and buyer’s state laws, including restrictions on certain firearms or magazines.

Inspections

  • We cooperate fully with ATF Industry Operations Investigators (IOIs) during compliance inspections, providing access to records and premises, per 27 CFR § 478.23.

  • Any violations identified are corrected promptly to maintain compliance.

Theft or Loss Reporting

  • Firearms thefts or losses are reported to the ATF within 48 hours, per 27 CFR § 478.39a.
